BRUSSELS

The oversight body of the International Criminal Court said on Monday that no decision has been made in an ongoing disciplinary process involving Prosecutor Karim Khan, stressing that the matter remains under review.

Paivi Kaukoranta, the president of the Assembly of States Parties (ASP) - which oversees the court - said the process is confidential and still underway, cautioning against speculation following recent media reports.

The case stems from an investigation launched in late 2024 after allegations of sexual misconduct were made by a member of the prosecutor’s office. Additional allegations surfaced in 2025. Khan has denied wrongdoing and took voluntary leave in May 2025.

As part of the process, the Assembly’s Bureau is reviewing findings from the United Nations Office of Internal Oversight Services (OIOS), the UN’s internal watchdog, along with advice from an independent panel of judicial experts.

“The matters are complex, and the Bureau is working diligently to make its decision in a proper manner and without delay with full respect for the due process rights and privacy of all persons affected,” the body said in a statement.

It also called for respect for the privacy of those involved and the integrity of the process.

Earlier media reports had suggested that a panel of three judges found no basis for misconduct by Khan. According to those reports, the panel concluded that the UN investigators’ findings “do not establish misconduct or breach of duty under the relevant framework.”

The ASP, made up of countries that have ratified the Rome Statute, serves as the court’s management and legislative body.

The allegations emerged as Khan’s office was pursuing investigations into alleged war crimes and genocide involving Israeli officials and military operations in Gaza. He has also sought arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant over alleged war crimes and crimes against humanity.
