Family of suspect in US firebomb attack can be deported, says US court

ANKARA

A federal judge in Texas has ruled that the family of an Egyptian national who is facing murder and hate crime charges over a firebomb attack can be deported, according to US local media.

With the decision, the court dismissed an attempt by the family of Mohamed Sabry Soliman to stop their removal, ABC News reported.

Soliman’s wife, Hayam El Gamal, was detained after the June 1 attack in Boulder, Colorado and was initially set for expedited deportation.

The deportation proceedings for her and the couple’s five children were later moved to Texas, where a judge had temporarily blocked the removal. That order has now been lifted.

US District Judge Orlando Garcia dismissed the family's legal petition.

“Upon review of the parties’ advisories, the record, and the applicable law, the Court finds that it lacks jurisdiction to grant Petitioners the relief they seek and must dismiss this case without prejudice,” ABC News quoted Garcia as saying.

Soliman faces multiple state charges, including first-degree murder, attempted murder, and assault.

He is also being prosecuted at the federal level and has pleaded not guilty to hate crime charges. A state court hearing is scheduled for July 15.

Egyptian-born Soliman had lived in Kuwait for 17 years before moving to the US, according to a state arrest affidavit.

Authorities say Soliman attacked a pro-Israel rally outside the Boulder courthouse by throwing Molotov cocktails at the crowd while shouting “Free Palestine.”

An 82-year-old woman injured in the incident, which was captured on video, has since died from her wounds.
